Class action alleges Menasha wrongly made workers scan their fingerprints

CHICAGO (From news reports) -- An employee is filing a class action lawsuit against a Wisconsin-based specialized packaging company, alleging it breached information privacy law by making workers scan their fingerprints when punching in and out of work shifts.

Noe Alvarez, individually and on behalf of similarly situated individuals, filed a complaint July 12 in Cook County Circuit Court against Menasha Corporation, alleging violation of the Illinois Biometric Information Privacy Act.
According to the complaint, Alvarez was employed by the defendant and was required to clock in and clock out on a biometric time clock scanning fingerprints. The plaintiff alleges he was unaware that Menasha was storing the information without his permission or consent, in violation of BIPA.

Alvarez seeks trial by jury, statutory damages of $1,000-$5,000 for each violation, attorney fees, court costs, interest and other relief. He is represented by attorneys William P.N. Kingston and Jad Sheikali of McGuire Law PC in Chicago.
